Enforcement action against ASX Participants

The Executive Office within ASX Compliance is responsible for bringing disciplinary action against market, clearing and settlement participants for breaches of ASX's operating rules.  

Currently, there are two disciplinary processes in place, depending on when relevant events occurred.

Disciplinary action in relation to operating rule breaches that occurred prior to 1 August 2010 are brought before the Disciplinary Tribunal in accordance with the ASX Disciplinary and Appeals Rulebook.  A right of appeal lies from decisions of the Disciplinary Tribunal to the Appeal Tribunal.

Disciplinary action in relation to operating rule breaches that occur on or after 1 August 2010 are brought before the ASX Chief Compliance Officer (CCO) in accordance with the ASX Enforcement and Appeals Rulebook.  A right of appeal lies from decisions of the CCO to the Appeal Tribunal.
